Famoty Privacy Policy

Famoty App’s LTD (“Famoty”, “we”, “us”, “our”) desires to protect the privacy of its Users. This privacy policy (“Privacy Policy”) is intended to provide you with a notice of our data management practices under the Famoty Application (“Famoty App”). Your use of Famoty App constitutes acceptance of this Privacy Policy.

For purposes of The General Data Protection Regulation 2016 (the “GDPR”) the data controller is Neosight Inc, with an office at 353 Sacramento str, San Francisco, California, USA, 94111.

PLEASE NOTE THAT THIS PRIVACY POLICY ONLY ADDRESSES OUR ACTIVITIES. IT DOES NOT APPLY TO ANY OTHER ORGANIZATION OR TO ANY OTHER ORGANIZATION’S APPLICATIONS, WEBSITES OR SERVICES EVEN IF YOU ACCESS THEM THROUGH Famoty APP. IF YOU DISCLOSE YOUR PERSONAL INFORMATION TO OTHER ORGANIZATIONS, YOUR INFORMATION WILL BE DEALT IN ACCORDING WITH THEIR PRIVACY PRACTICES.

1. Definitions.

We means the Neosight Inc.

You means the user of the Famoty App.

Personal data means any information relating to you and helping identify you (directly or indirectly), in particular by reference to an identifier such as your name, identification number, location data, an online identifier or to one or more factors which may enable a third person to identify you as a natural person.

Data subject means you as the subject of personal data held by us.

Controller means a natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.

Joint controllers means two or more controllers who jointly determine the purposes and means of processing of personal data.

Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Famoty Services means access to Famoty Application, and all the services provided to you by Famoty via the Famoty Application in accordance with this Terms of Service. 

Famoty Application (“Famoty App”) means a software installed from various app stores, accessed or otherwise used by you on your devices (mobile phones and tablets) through which you can access the Famoty Services.

2. Data Collection and Use.

Personal Data

We require you to provide and we collect only the personal information that is needed to fulfill your requests data while using Famoty App. If you decide to provide us your personal information in one of the ways discussed in this Policy (e.g., name, email address) we will collect only the personal information that is needed to fulfill your requests, as described below.

General Information

We may collect information about your use of Famoty App. Such information may include user`s inner ID number that is assigned to User following the first usage of Famoty App, technical information on your usage of the Famoty App (namely, chosen settings options), your “click path” through Famoty App, your rating to Famoty App or its functions. We may use this information for internal purposes, such as, usage analysis, improving usability of Famoty App, making functionality Famoty App available to you.

You understand that by using Famoty App, you give us your consent to use provided information.

Data under Famoty Support Centre

If you have any questions or complaints regarding this Policy or use of Famoty App, you may contact us through Famoty Support Centre available on Famoty App, or by email at famoty.app@gmail.com. The following personal information (but not limited to) might be provided due to this action: email, name.

User’s email, name and message would be stored by us for the purpose of further communication only, namely to respond to your questions, comments or send any requested information to you. If you wish to delete email communication with us, you may contact us and we will delete any emails related to you within three business days.

You understand that by contacting the Famoty for any reason, you give us your consent to process your data voluntary provided to us.

CCPA Privacy Rights (Do Not Sell My Personal Information)

Under the CCPA, among other rights, California consumers have the right to:

Request that a business that collects a consumer’s personal data disclose the categories and specific pieces of personal data that a business has collected about consumers.

Request that a business delete any personal data about the consumer that a business has collected.

Request that a business that sells a consumer’s personal data, not sell the consumer’s personal data.

If you make a request, we have one month to respond to you. If you would like to exercise any of these rights, please contact us.

3. Use of Personal Data.

Famoty uses the data collected for the following purposes including, but not limited to:

• to provide, maintain and improve Famoty Services;
• to provide User support;
• to respond to User`s questions;
• to fulfill User`s requests;
• to achieve any other goals for which information was collected.

For your fulfill using of Famoty App you may provide such information:

• name of your family members that are planning to use Famoty App (you may setup any name or nickname, we do not check this information)
• age and sex (you may setup any information, we do not check it)
• access to phone camera

Name, age and sex is used for tasks, rewards and statistic for users inside of Famoty App. This information is needed only to fulfill providing app’s services. Camera is used to provide proof of completed tasks if necessary.

4. Grounds for Processing of Personal Data.

Famoty uses the data collected for the purposes described above on the basis of your consent provided as described in Data Collection and Use Section.

5. Disclosure of Personal Data.

Famoty does not share and disclose your personal data to third parties.

6. How Long Do We Maintain Personal Data?

Famoty stores your Personal Data for the period that is necessary for the purposes set out in this Privacy Policy only. Famoty will retain and use your Personal Data to the extent necessary to comply with its legal obligations (for example, if retention of your data is required in order to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.

7. Advertising.

We may display advertisements managed by third parties on Famoty App (“advertising partners”), that are defined in this Privacy Policy.

We only use Google Play certified ad SDKs to display ads to Famoty App’s users. We do not use interest-based advertising or remarketing.

Please be aware that Famoty does not have access to that data and do not control the advertisements content that will be shown to you.

8. Links to Other Websites.

Using the Famoty App, you can get a link to websites/applications/services that we do not have control on. Please be aware that Famoty is not responsible for the content, privacy policies and practices of any third party websites/applications/services.

This Privacy Policy does not apply to these websites/applications/services, or to any collection and processing of your personal data obtained by third party when you click on link to its websites/applications/services. We advise you to review the Privacy Policy of these websites/applications before using them.  

9. Rights of the Data Subjects.

The data subjects whose personal data we process as a data controller have the following rights:

• right of access (i.e. you may ask us to send you a copy of the data about you that we collected);
• right to rectification (i.e. you may ask us to correct the outdated or false data, or complete the data which is missing or incomplete)
• right to erasure (i.e. you may ask us to delete the personal data we retain, provided that the GDPR allows you to do so);
• right to restriction of processing (if processing may be restricted under the GDPR)
• right to object to processing (if the GDPR reserves your right to object as to certain kinds of processing or in certain circumstances)
• right to data portability (i.e. you may ask us to transfer a copy of your data to another organization or to you provided that the circumstances comply with the GDPR).

We do not charge any fees in relation to exercising your rights protected by the GDPR. We typically do our best to answer you as soon as possible or within the reasonable period taking into account the complexity of the request, but in case we are processing a large amount of requests the answer may took us longer than you might expect.

10. Right to Withdrawal Of Consent.

The data subject, whose personal data we process as a data controller based on consent, is entitled to withdraw consent at any time, without affecting the lawfulness of processing based on consent before the withdrawal.

We will verify your withdrawal of consent within 72 hours since the receipt of your request.

11. Updates to this Privacy Policy.

Famoty reserves the right to update or amend this Privacy Policy occasionally. We will notify you of any changes by posting the new Privacy Policy. To the maximum extent permitted by applicable law, by using Famoty App after such notice, you consent to updates or other modifications to this Privacy Policy.
